§1 General

All texts, images, and other information published here are subject to the copyright of the provider, unless third-party copyrights exist. Reproduction, distribution, or public display is permitted exclusively with the revocable and non-transferable consent of the provider.
§2 Conclusion of Contract
1) A purchase contract is concluded as follows:
a) The consumer makes a binding purchase offer by acting as follows.
b) The consumer places the desired products in the desired quantity into the shopping cart.
c) The consumer navigates to the shopping cart and can change or delete the quantity of products there.
d) The consumer enters their data (name, address, e-mail)
e) The consumer selects a payment method
f) The consumer reviews all their information in the overview once more
g) The consumer clicks on "order now subject to payment"
1a). The order is placed.
Mineralien-online bindingly accepts the purchase offer through the following actions (except in cases of non-payment, out-of-stock items, ……..
1) Sending an order confirmation by e-mail
2) Complete delivery
3) If a contract is concluded, it is between the following parties:
a) Mineralien-online Beyerl, Obere Akaziengasse 2, A-7143 Apetlon
b) The consumer with the data provided by them on our website www.mineralien-online.at during the ordering process.
§3 Prices
All prices are in Euro, including 0% VAT, and all duties (Note: VAT exempt - small business owner according to §6 para. 1 Z 27 USTG)
1. The prices at the time of the order apply.
2. We reserve the right to correct errors and mistakes in pricing, such as spelling errors, calculation errors, out-of-stock items, or pricing errors.
§4 Offers
1 All offers stated on the website are non-binding and represent a non-committal sales offer, which only becomes binding upon order confirmation.
2 In the case of typing and calculation errors as well as mistakes on the website, Mineralienonline is not obliged to accept the offer and execute the order.
3 All offers are fixed prices and cannot be sold at a reduced price through purchase (please make use of the right of withdrawal), with the exception of promotions initiated by us.
4 The pictures of the stones, jewelry, and minerals are predominantly enlarged; please note the size specifications in the item description.
5 Since the pictures are partly edited and can be misleading regarding appearance (photography, color, size...), no price reduction can be granted; please make use of the right of withdrawal.
6 All our gemstones have been examined to the best of our knowledge and belief (electronic and manual gemstone testing devices). Errors and misprints are reserved. The weights and sizes given in the shop are approximate. I guarantee the authenticity of the gemstones. If a stone shows treatment, it will be noted separately in the item description. Since gemstones are predominantly heated, heating does not constitute a treatment. Should the buyer discover that a stone is not natural, even though it was marked as natural (unless stated in the item description), they can return the stone to us at any time, and the purchase price and shipping costs will be refunded (including return shipping). An equivalent replacement is excluded by us. Stones are unique, therefore an equivalent replacement is excluded. If the consumer has consulted a recognized gemological institute, we will reimburse costs up to a value of €150, in conjunction with an invoice.
§5 Delivery
1 Delivery times: Ordered products will be shipped within 3 working days after receipt of payment, unless a different delivery time is specified for the products, or it is a special order.
2 Shipping costs:
Amount to €5.80, regardless of how much you buy. From €120, we deliver free of shipping costs.

Shipping costs for other listed countries: €15.90

We deliver to the following countries:

Belgium, France, Hungary, Italy, Luxembourg, Netherlands, Norway, Poland, Sweden, Switzerland, Denmark, Greece, Croatia, Liechtenstein, Slovakia, Slovenia, Spain, Czech Republic.

§6 Payment
1 The consumer has the option of payment via the payment methods specified in the shop or by bank transfer (prepayment)
3 The goods remain the property of Mineralienonline until full payment.
§7 Right of Withdrawal
1. The consumer has the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.
2. To exercise your right of withdrawal, the consumer must provide the following data without justification:
o Name
o Address
o Telephone number
o E-mail address

by means of a clear statement (e.g. a letter sent by post, e-mail)
You can use the attached sample withdrawal form for this, but it is not mandatory.

An email with the notification that you are withdrawing from the purchase is also sufficient.

3. There is no right of withdrawal for the following contracts:
a. Goods that have been manufactured according to customer specifications or are clearly tailored to the personal needs of the customer.
b. When purchasing a lot, the entire lot must always be returned; splitting the lot is not possible.

c. for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;

4. If the consumer withdraws from this contract, we shall reimburse him for all payments we have received from him, including the delivery costs (with the exception of the additional costs resulting from the fact that he has chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which the notification of his withdrawal from this contract has reached us. For this repayment, we will use the same means of payment that the consumer used for the original transaction, unless expressly agreed otherwise with him; in no case will the consumer be charged fees for this repayment. No refund for return shipping.
§8 Data Protection
1. The use of our website is possible without disclosing personal data. The disclosure of personal data, e.g., during the ordering process, is always voluntary.
2. Personal data collected during the ordering process will only be used in the following standard applications in accordance with Standard and Sample Regulation 2004 (StMV 2004), BGBl. II No. 312/2004:
a. SA001 Accounting and Logistics
b. SA022 Customer care and marketing for own purposes
3. The data necessary for business transactions will be stored and, if necessary, passed on to affiliated companies and service partners in the course of order processing.

§9 Warranty and Liability
For consumers, the statutory warranty and liability provisions apply.
§10 Final Provisions
1. Applicable law is Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods.
2. Place of performance and jurisdiction for Mineralienonline is Neusiedl/See.
3. Severability Clause
Should any provision of these General Terms and Conditions be ineffective, the remaining provisions shall remain unaffected. The ineffective provision shall be deemed replaced by a provision that legally and economically comes closest to the meaning and purpose of the ineffective provision. The same applies to any regulatory gaps.
